The lawyer Alessandro Paone assisted ITALTEL in managing the complex corporate reorganization procedure, concluding, on 6 May and after long negotiations with the unions, the agreements that will allow the company to proceed with the revision of its organizational structure while minimizing the social impacts.
In particular, ITALTEL – historic Italian multinational of Information & Communication Technology – after intense trade union negotiations with the RSUs of the various offices and the National and Territorial Secretariats of FIOM, FIM and UILM, reached an agreement on the afternoon of 6 May with the social partners which made it possible to implement the plan for the revision of the workforce and the updating of skills in a socially responsible manner in line with the provisions of the industrial plan, all without implementing any unilateral procedure and making the most of trade union dialogue, preserving thus the internal and external climate, in the interest of protecting the corporate ecosystem at every level.
In order to avoid the use of traumatic instruments, a Solidarity Contract has been stipulated for a duration of 12 months, aimed at specific areas and skills, supported by an early retirement incentive plan for 68 resources reserved primarily for the company areas affected by the replacement interventions and change of professionalism.
The lawyer Paone worked by assisting ITALTEL at every moment of the reorganization, right from the structuring on the management, strategic and communication, trade union and institutional levels, together with the Management Consultant Dr. Donato Caldarulo for all the administrative and management aspects of the social safety net. The team of professionals operated, on the ITALTEL side, alongside the Chief HR & Organization, Dr. Michele Saracino.
For Alessandro Paone “The agreement is the result of trade union dialogue that the company has been able to exploit. It was decided, as is not always the case, to focus on dialogue by investing in the trust of the parties at the table, avoiding the opening of unilateral legal procedures which sometimes, even when necessary or even mandatory, are perceived as muscular actions creating tensions that are of little use to the resolution of business problems, if not impediments. In this case, a space had been created and it was decided to explore it. This was done in the belief that some business challenges that have a significant impact on people certainly deserve to be addressed with high technical competence, given the difficulty of executing similar processes. on a labor law level, but also with enormous tact and humanity, so that the process of change is understood and shared at every level, despite the differences that the parties at the table always have in these matters”.

Ricordo che il Piano Industriale di ITALTEL si basa, tra le altre cose, su un adeguato dimensionamento aziendale e contemporaneamente su interventi di aggiornamento delle competenze, su un pervasivo percorso di change management con la volontà di preservare il valore della persona e del lavoratore ”. Per Saracino dunque “L’intesa raggiunta è volta a consentire la definitiva realizzazione del piano ed a gestire le modifiche organizzative insorte nel corso dell’anno 2024 anche in ragione dei grandi cambiamenti nel mercato in uno scenario globale così liquido e di veloce cambiamento”.
